These Terms of Service (“Terms”) govern participation in educational programs and services provided by Ark Academy (“Ark Academy,” “we,” “our,” or “us”).

By enrolling in or participating in Ark Academy programs, the parent or legal guardian (“Parent,” “you,” or “your”) agrees to these Terms on behalf of themselves and the participating student.

If you do not agree to these Terms, you may not participate in

Ark Academy programs or services.

1. Parent-Controlled Participation

Ark Academy programs are designed for minors and require parent or legal guardian involvement.

By enrolling a student, you confirm that:

  • you are the student’s parent or legal guardian, or are otherwise legally authorized to enroll the student

  • you are responsible for the student’s participation and conduct

  • you provide all required consents and permissions

  • you agree to these Terms and the Ark Academy Privacy Policy

Parents are responsible for ensuring that students participate

in an appropriate environment and use the services safely

and respectfully.

Parents may observe or supervise students outside of the instructional experience, but are not participants in the classroom unless explicitly authorized by Ark Academy.

2. Enrollment & Program Participation

Enrollment in Ark Academy programs is subject to:

  • available capacity

  • program eligibility

  • operational scheduling

  • compliance with these Terms

Ark Academy reserves the right to:

  • modify schedules

  • update program structures

  • change instructors

  • adjust curriculum or program formats as reasonably necessary

Certain pilot programs may be offered free of charge.

3. Credit-Based System

Ark Academy may operate using a credit-based participation system.

Credits may be:

  • purchased or granted

  • redeemed for eligible classes or activities

  • subject to program-specific rules or limitations

Unless otherwise stated:

  • credits expire 12 months from the original purchase date

  • expired credits are non-refundable and may not be restored

Ark Academy may update credit structures, pricing, or usage policies over time.

4. Attendance, Absences & Cancellations

Students are expected to attend scheduled sessions on time

and participate respectfully.

Because many classes are conducted in group formats:

  • missed classes are generally not rescheduled

  • make-up classes are not guaranteed

If a parent notifies Ark Academy of an absence in advance according to applicable program guidelines, the associated class credit may not be deducted.

Students who miss classes without advance notice may forfeit

the associated credit.

If Ark Academy cancels a class:

  • replacement classes

  • credit restoration

  • or other reasonable accommodations

may be provided at Ark Academy’s discretion.

Recorded sessions may be made available to enrolled students

for review during active enrollment periods.

5. Classroom Conduct & Safety

Students are expected to:

  • behave respectfully

  • participate appropriately

  • avoid disruptive, abusive, unsafe, or harmful behavior

Ark Academy reserves the right to:

  • remove participants from sessions

  • suspend participation

  • terminate access to services

if behavior is determined to be disruptive, unsafe, inappropriate, or harmful to the learning environment or other participants.

6. Class Recordings

Ark Academy classes may be recorded for educational, operational, quality assurance, and technology improvement purposes.

Recordings may be used for:

  • educational review and student playback access

  • teacher training and quality assurance

  • curriculum development and program improvement

  • internal operational review

  • development, testing, and improvement of educational technology, learning tools, and artificial intelligence systems using de-identified or aggregated information where reasonably practicable

Access to Recordings

Recordings may be accessed only by:

  • authorized administrative personnel

  • educational management staff

  • assigned teachers and instructional personnel

  • enrolled students and their parents or guardians during active enrollment periods, as permitted by Ark Academy

Recordings provided to students and families are generally available on a view-only basis unless otherwise authorized by Ark Academy.

Restrictions

Parents, guardians, and students may not:

  • redistribute recordings

  • publicly share recordings

  • copy, reproduce, or commercially use recordings

  • download recordings unless explicitly permitted by Ark Academy

Retention and Multi-Participant Recordings

Because class recordings may include multiple students participating in the same session, Ark Academy may retain recordings for the educational benefit of other enrolled students even if an individual participant later withdraws consent or requests deletion of personal information.

Where required by applicable law and reasonably feasible, Ark Academy will take reasonable steps to remove, redact, or de-identify personal information associated with an individual participant.

Promotional Use

Ark Academy will not use recordings, screenshots, student projects, testimonials, or other participation materials for promotional, marketing, or public-facing purposes without any additional consent that may be required by Ark Academy's policies or applicable law.

7. Optional Media & Marketing Consent

Ark Academy may request separate optional consent for the use of selected materials for promotional or marketing purposes.

These materials may include:

  • class recordings or clips

  • screenshots

  • student projects

  • testimonials

  • participation materials

Participation in Ark Academy programs does not require media or marketing consent.

Parents may withdraw optional media consent by contacting:

8. Intellectual Property

All Ark Academy materials, including but not limited to:

  • curriculum

  • lesson content

  • presentations

  • teaching materials

  • recordings

  • branding

  • written materials

  • educational frameworks

remain the intellectual property of Ark Academy or its licensors unless otherwise stated.

Participation in Ark Academy programs does not transfer ownership rights to parents or students.

Parents and students may not:

  • reproduce

  • distribute

  • modify

  • commercially exploit

Ark Academy materials without prior written permission.

9. Privacy

Ark Academy’s collection and handling of personal information is governed by the Ark Academy Privacy Policy.

By participating in Ark Academy programs, you acknowledge and agree to the applicable Privacy Policy.

10. Suspension & Termination

Ark Academy reserves the right to suspend or terminate access to programs or services if:

  • these Terms are violated

  • participation creates operational, safety, or legal concerns

  • conduct is disruptive or harmful

  • misuse of services or materials occurs

Termination decisions will be made at Ark Academy’s reasonable discretion.

11. Disclaimer of Warranties

Ark Academy programs and services are provided on an “as available” and “as provided” basis.

While Ark Academy strives to provide high-quality educational experiences, we do not guarantee:

  • uninterrupted availability

  • error-free services

  • specific educational outcomes

  • compatibility with all devices or internet environments

12. Limitation of Liability

To the maximum extent permitted by law, Ark Academy and its affiliates, officers, employees, contractors, and representatives shall not be liable for:

  • indirect damages

  • incidental damages

  • consequential damages

  • loss of data

  • interruption of services

  • educational outcomes

  • third-party platform failures

arising from participation in Ark Academy programs or services.

13. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to These Terms

Ark Academy may update these Terms periodically as programs, operations, or legal requirements evolve.

Updated versions will be posted with a revised “Last Updated” date.

Continued participation after updates constitutes acceptance of the revised Terms.
